Q. I have been told that under the new Mental Health Act my son will be taken into a mental institution because he has learning disabilities. Is that true?
A. Learning disability can now be categorised as a mental disorder but only if it is associated with abnormally aggressive or seriously irresponsible behaviour. If the latter occurs he can be detained under Section2 for an assessment or Section3 for treatment. Other than that, he can continue to live in the community as normal.

Q. My father has become incapacitated and we don’t have a Power of Attorney to handle his affairs. What can we do?
A. You can apply to the Court of Protection for an Order to become his deputy both for his property and financial affairs and also all his welfare matters.
